New legislation has been passed to try and minimise tactics like this but my advice is simple - don't buy off the plan. 9/10 times you're going to have to raise a significant special levy to cover the cost of appointing lawyers & engineers to rectify the defects. If you do buy off the plan make sure you have some spare cash to pay those special levies.

As a strata manager with 5 years experience, all I can say is don't buy off the plan, unless you like the idea of being fucked over. New buildings are notorious for defects, you're better off going for a building that's 10+ years old and has sorted out its defects.

4 out of 5 new building have defects, whether they are major or minor is another question. I managed a block of 17 townhouses that had to raise $700,000 to repair defects... That's about $42,000 per owner, they might have some luck recovering those costs from the original developer in court but they've also spent about $40,000 to date in legal costs and the courts never award 100% of legal costs so in the end they are going to lose a lot of money
As a professional strata manager I'll give you all one piece of advice: NEVER BUY OFF THE PLAN!! buildings built in modern time almost always have major defects, as a new owner you will be forced to pay thousands of dollars in special levies for a lawyer to sue the developer and a builder to fix their mistakes.

Lived in Lane Cove all my life, very green, leafy and friendly. There's lane cove national park as well if you like getting amongst nature. Lane cove is perfect for public transport (easy to go north, west, south and there's express buses to the city that take you there in ten minutes). This clause of the new Strata Schemes Management Act is designed to stop the little old granny that lives in the building, who is probably going to pass away in a few years and objects to the redevelopment of the building simply because they don't want it to happen, without having to give any solid reason as to why. It's designed for the older blocks that are 60-100+ years old which in most cases are so expensive to repair and maintain that they force the strata schemes levies so high that the owners can barely afford to live there any more anyway. This can be incredibly frustrating when it comes to a block of say 100 units, where everyone except for the little old granny wants to re-develop but they can't because the current laws require 100% of the Owners to approve by a Unanimous Resolution at a general meeting.
As a strata manager I've actually met Jimmy Thompson (author of this article) and while he can be insightful, he's actually just an Owner within a few strata blocks, he's no expert by any means!
Where he says that 75% need to agree, he is technically wrong. This clause (one of the many changes in legislation to be made via the new Strata Schemes Management Act) he is referring to would state that the Owners would need to pass a Special Resolution to approve the re-development. A Special Resolution means that no more than 25% of the Owners can vote AGAINST the motion, in many cases owners might decide to abstain against voting but with a special resolution it will be passed unless 25% object to it.
If you're passionate and can present a viable reason as to why the Owners should continue to maintain a very old building then you should voice your opinion to the other Owners and try and get them on your side.
